The Second Circuit denied the FDA’s motion to stay, pending an appeal, a lower court ruling demanding immediate over-the-counter access to the two-pill version of Plan B. The federal appeals court granted a stay, pending appeal, of making the one-pill versions of emergency contraception available over-the-counter.
