In a landmark ruling, the U.S. Court of Appeals for the D.C. Circuit held that Assistant Chief Newsham was not entitled to qualified immunity for the September 2002 mass arrest of protestors and others in Pershing Park. The Court called his arguments “indefensible” and “ludicrous.”
